Zusammenfassung

Mit seinem Recht der Völker hat John Rawls für tiefe Enttäuschung gesorgt, bleibt sein letztes Buch doch weit hinter den Erwartungen zurück, die er mit seiner Theorie der Gerechtigkeit für eine Theorie globaler Gerechtigkeit geweckt hat. Nicht wenige erwarteten, dass die darin vorgestellte „original position“ nicht nur als Legitimationsargument für binnenstaatliche Gerechtigkeitsgrundsätze, sondern auch für Gerechtigkeitsgrundsätze mit globalem Anspruch und globaler Reichweite taugt. Denn die Theorie der Gerechtigkeit hatte einen eindeutig universalistischen Impetus: alle Menschen sind Träger*innen bestimmter liberaler und ökonomischer Rechte, die sich aus den beiden Gerechtigkeitsgrundsätzen folgern lassen, die unter fairen Bedingungen im Urzustand gewählt wurden.
