Zusammenfassung

Der Sonderfachmann haftet nicht nur für fehlerhafte Planungsleistungen, die zu einem Mangel an der baulichen Anlage oder des Einzeigewerkes führen, sowie für Verletzung von Vertragspflichten während der Ausführung der baulichen Anlage, wenn ihm die örtliche Bauleitung oder Gesamtleitung übertragen ist. Er kann auch bereits nach Eintritt in die Vertragsverhandlungen durch Verletzung von Aufklärungs- und Treuepflichten Schadensersatzansprüche des Auftraggebers auslösen.
