Zusammenfassung
In dem vorliegenden Kapitel werden wir uns mit der Frage auseinandersetzen, ob der Kapitalmarkt effizient ist. Die Relevanz dieser Frage für diese Arbeit darf nicht unterschätzt werden. Denn das sog. Informationsrisiko, das durch asymmetrische Informationen verursacht wird, ist die Grundlage des zwingenden Aktienrechts.104 „Asymmetrisch nennt man eine Informationsverteilung, wenn es Informationsvorsprünge gibt, d.h. wenn ein oder einige Marktteilnehmer besser informiert ist bzw. sind als andere oder es zumindest sein könnten, und wenn die anderen dies wissen oder befürchten müssen. Mit anderen Worten: ein Marktteilnehmer weiß etwas oder könnte etwas wissen, was andere nicht wissen, aber wissen wollen.“105
