Abstract
Décriée par une minorité d’Etats de la communauté internationale, la Cour pénale internationale est sujette à de nombreuses controverses, à la fois politiques, économiques et juridiques. La notion de ‘culture’ se retrouve indirectement au cœur de ces controverses. La Cour doit donc faire face à plusieurs défis culturels dans l’exercice de son mandat juridictionnel. De tels défis avaient été anticipés par les rédacteurs du Statut de Rome dès le Préambule. La Cour doit opérer avec les outils prévus par son Statut pour résoudre ces défis particuliers. D’un côté, elle va tenter d’intégrer le métissage des cultures juridiques dans le cadre de son travail. D’un autre côté, la Cour va venir protéger la culture de manière indirecte en poursuivant des crimes internationaux.
Abstract
Scorned by a minority of States from the international community, the International Criminal Court is subject to numerous political, economic and legal controversies. The notion of ‘culture’ happens to be indirectly at the core of these debates. Hence, the Court must face a series of cultural challenges in the exercise of its jurisdictional mandate. Such challenges had already been anticipated by the drafters of the Rome Statute right from the preamble. The Court must operate with the tools provided in its Statute in order to solve these particular challenges. On the one hand, it will try to integrate the mixing of cultures in its work. On the other hand, the Court will indirectly protect culture through the persecution of international crimes.
