Abstract
As the American higher education system continued to develop from the Colonial Period, it wasn’t until the beginning of the twentieth century that the growing concern about faculty job security came to the forefront of educators. Although the US Constitution provided all citizens with protections in the First and Fourteenth Amendments, it was the case of Edward Ross that spurred the AAUP to take up the cause known as faculty tenure. This chapter begins with an examination of the criticisms leveled against tenure followed by a review of lower court decisions pertinent to faculty protection based on the First and Fourteenth Amendments.
