§ 10 Should the Portuguese Courts Use the DCFR Concept of “Legally Relevant Damage”?

At this point, it has been argued that the Portuguese courts can use the DCFR where the domestic legal provisions do not provide an effective solution to a given legal dispute. The question thus follows if, among its 56 rules on non-contractual liability arising from damage caused to another, the DCFR contains a workable solution for the protection of pure economic interests considered worthy of legal protection by the courts.
