Abstract
In order to assess the legitimacy of criminalising corruption, it is necessary, first, to develop a concept of corruption which adequately captures the different behaviours that can plausibly be considered corrupt. And second, it is necessary to be clear not only about what harm corruption produces but also what its moral wrong consists in, and what is the degree of its moral wrong according to the moral typology of each kind of corrupt conduct. These considerations provide a matrix of analysis that is useful both to control the plausibility of existing criminal law that punishes corruption and to propose reforms of the law which are consistent with the moral convictions that actually exist in society regarding this problem.
