Abstract
The New York Convention has been moderately applied in Brazil. Since 2005, the Superior Tribunal de Justiça has decided 38 requests for recognition and enforcement of foreign arbitral awards, denying the petition on six occasions. The Superior Tribunal de Justiça has sometimes failed to properly apply the Convention on account of its lack of experience and knowledge of international case law regarding its application. Eventually, this issue may generate a general sense of uncertainty over the application of the Convention in Brazil.
Lauro Gama, Jr. is one of the founding partners of Binenbojm, Gama & Carvalho Britto and the former president of the Brazilian Arbitration Committee (CBAr). He he has acted as counsel and arbitrator in more than 50 cases, under the rules of ICC, LCIA, UNCITRAL and Brazilian arbitral institutions. He is fluent in Portuguese, English, French and Spanish.
Bruno Teixeira is an associate at Mattos Filho, Veiga Filho, Marrey Jr. e Quiroga Advogados in Rio de Janeiro. He holds a Master of Laws (LL.M.) degree from NYU School of Law. His practice focuses on international and domestic arbitration and complex litigation.
