Abstract
The Swedish word “rättshandlingsförmåga” or legal competence refers to an individual person’s lawful right to make agreements and decisions about his or her property and life. All adults in Sweden are considered to have legal competence unless proven otherwise. During the past decades, the Swedish society has moved towards more respect for individuals, albeit demented, mentally ill or retarded. Respect for everyone’s autonomy is emphasized in social and medical law. The law states clearly that as little coercion as possible should be used.
