Services Liberalisation in the Internal Market

Abstract

There have been few examples of European Community (EC)-internal market legislation which have been discussed as widely and emotionally as the Services Directive (SD).1 This broad participation far beyond stake holders gave the impression that this legislative act might equally be able to and aiming at changing the fundamentals of the European Union. Although arguments brought forward in that public discussion had regularly only little to do with the actual proposal, the consideration as an exceptional piece of legislation was right. Indeed, the SD’s aim and purpose is to change the legal framework of EU’s service industry, accounting for about 75% of average employment in EU- national economies.2 To this respect, today’s EC-internal market legal framework is considered insufficient for the full realisation of the economic potential. It is thus the main objective of the Directive to develop a new, improved EC regulatory approach in order to overcome today’s legal short-comings. The evaluation of that objective, in other words an analysis of change, is also the main purpose of the present study. As a consequence the first chapter focuses on today’s legal status-quo, hereby presenting relevant EC primary as well as secondary legislation in the field of cross-border service provision (II. Cross-Border Service provision in the Internal Market under the Current Legal Framework)

When referring to the “Services Directive (SD)” or the “Directive”, this paper means the version of the directive as published in the Official Journal of the European Union L 376/36, 27.12.2006: Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006 on services in the internal market. Draft Services Directive 2004 (“DSD 2004”) means the proposal for a Directive of the European Parliament and of the Council on services in the internal market, COM(2004) 2final/3 of 5 March 2004. Draft Services Directive 2006 (“DSD 2006”) means the amended proposal for a Directive of the European Parliament and of the Council on services in the internal market, COM(2006) 160 final of 4 April 2006.
