Remote Investment Transactions in the Digital Age

Abstract

In the conditions of the information society and the digital economy, the introduction of information technologies and the development of remote banking services is qualified as one of the main directions of the development of the banking products market and one of the important conditions for the competitiveness of a credit institution. In order to determine the approaches to the development of optimal legal support for RBS, to correlate existing forms with existing legal structures for their unification and standardization, to ensure law and order in banking, a comparative legal analysis of international, supranational and national law, statistical data, doctrinal literature, primarily on the issues of objects of civil rights, the provision of services, banking law and the national payment system, transactions and remote transactions, digital technologies. The absence of a definition of remote services in Russian legislation is revealed, the possibilities of using the European concept of a remote contract and the Russian “remote sale of goods” are considered. The criteria of differentiation of remote, network and electronic services are outlined. The classifications of remote services are generalized in terms of the technologies used and by the level of contact. The conclusion about the gradual appearance, but simultaneous coexistence of types of DBO is substantiated. The most significant elements of banking and information legislation for DBO are analyzed. The characteristics of banking operations, products, transactions, technologies and services are proposed. A “working” definition of RBS has been developed, ways of developing legislation and technical and legal acts on the subject of research have been outlined, first of all, it is necessary to determine priorities: a special transaction, a special—electronic—form of transactions or a special technology.
