Abstract

The defense of Democracy its Rule of Law and the Constitution in the EU Member States requires the adoption of an exception and emergency Constitution, which includes uniform minimum standards, both substantive and procedural, of a European scope. Since a Right of exception or an emergency Constitution of European scope would allow: a rapid response to that set of situations that determine a fracture in the legal order, endangering its permanence and the fundamental principles of democratic Constitutions; impose limits on a unilateral and arbitrary exercise of power to the detriment of the fundamental rights and freedoms of individuals; establish uniform minimum standards for the protection of fundamental rights, freedoms and common measures for a joint intervention of the EU and, along the way, would allow the reinforcement of the legitimacy and sense of State of the EU, which would act together to safeguard the rights of the EU. Fundamental interests of all its Member States and at the same time, a bond of union and democratic and reciprocal cooperation would be created between all the Member States of the European Union.

La defensa de la Democracia, de su Estado de Derecho y de la Constitución en los Estados Miembros de la UE requiere la adopción de una Constitución de la emergencia y de excepción, que recoja estándares mínimos uniformes, tanto sustantivos como procesales de alcance europeo. Ya que, un Derecho de excepción o una Constitución de la emergencia, de alcance europeo permitiría: responder rápidamente a aquel conjunto de situaciones que determinan una fractura en el orden jurídico, poniendo en peligro su permanencia y los principios fundamentales de las Constituciones democráticas; imponer límites a un ejercicio unilateral y arbitrario del poder en detrimento de los derechos y libertades fundamentales de las personas; establecer estándares mínimos uniformes de tutela de los derechos y libertades fundamentales y de medidas comunes para una intervención conjunta de la UE y, de camino, permitiría reforzar la legitimación y el sentido de Estado de la UE, la cual actuaría unida para la salvaguardia de los intereses fundamentales de todos sus Estados miembros y a la vez, se crearía un vinculo de unión y cooperación democrático y recíproco entre todos los Estados partes de la Unión Europea.
