Principles for China’s International IP Engagement

Abstract

This chapter discusses contesting principles that have guided or constrained China’s international IP engagement. Data examining China’s behaviour in the case studies (Chapters 26) help identify two core sets of principles in China’s approach to IP: IP instrumentalism and foreign policy principles. This chapter first examines IP instrumentalism and its manifestations via innovation stimulation theory and economic contribution theory. It then examines the foreign policy principles. It further analyses the evolution of both principles and how such evolution may cause potential conflicts between the two sets of principles. Prominently, the transition from IP instrumentalism to an entitlement-based theory does not only indicate China’s changing attitude in terms of distributive justice in relation to IP, it also has broader implications at the global level.
