A Critical Analysis of the Dark Web Challenges to Digital Policing

Abstract

This chapter critically analyses the challenges to the digital policing caused by the anonymity and growing criminal market of the Dark Web. The police face many ethical and jurisdictional issues when monitoring illicit activity, particularly in the case of online paedophilia and child pornography that circulates the web. Issues arise of who is responsible for prosecuting crimes committed on international scales and how internet crimes can be detected in an ethical way that maintains a degree of privacy and privacy rights to its legitimate users. Enforcement agencies have adapted effective investigative techniques such as NIT to takedown illicit sites such as ‘Playpen’ and have demonstrated a degree of success. The current strengths of digital policing can be recognised, yet international cooperation and communications within the private sector demonstrate further preventative measures.
