Neuro-Rights and Ethical Ecosystem: The Chilean Legislation Attempt

Abstract

The different challenges of the Fourth Industrial Revolution and its global automation of processes and services, today imply new risks related to a possible violation of our privacy and free decision-making, by virtue of new technologies that would analyze brain functioning linked to our emotional capacity, thoughts and reactions. Neurorights aim to protect our personal identity and the exercise of free will, with new legislation as in the case of Chile, to regulate this type of technology. In this text we argue that neurorights must involve an ethical ecosystem and a certain conception of the human being, considering all global technological, legal, and anthropological interactions, to guide us on what to preserve or remove from our relationship with new technologies.
