Negotiating an Environment Protocol: November 1990 to April 1991

Abstract

In 1990, the Antarctic Treaty Parties met in Chile to consider measures for improving environmental protection as well as the threshold issue of mining in Antarctica. One test of the latter would be whether Parties would proceed with liability rules for the minerals convention. Discussing these rules was abandoned when it became clear that there was insufficient support for the Antarctic minerals convention. Several options for environmental regulation were proposed, and considerable negotiation effort was required to determine the scope, content and form of an overarching regime. An informal draft prepared by Norway helped show how a regime might operate, although there was no agreement on whether it would take form of a Treaty protocol or stand-alone convention. A key issue was the treatment of mining, and, after considerable debate, the draft included a provision that could allow for mining to be prohibited. The regime was incomplete but formed the basis of diplomatic campaigning to continue. Further movement in Parties’ positions occurred, including Japan’s decision to drop support for the minerals convention. With rapid change in attitudes, Parties prepared for the resumption in April 1991 of formal negotiations of what would become the Madrid Protocol.
