Abstract
Ethics commissions are increasingly involved in the assessment of research projects in Germany and Italy, especially in the field of clinical studies and research funding. In such assessments, there is often conflict between the academic freedom of researchers and other constitutional values, particularly the rights of patients and probands in clinical studies. A proportional balance between these conflicting values needs to be found. Although the involvement of ethics commissions may pose a threat to academic freedom, there are also positive aspects, such as legal certainty and reduced legal scrutiny.
