Abstract

Foreign economic activity is carried out by performing actions by its participants aimed at the emergence and fulfillment of obligations. The purpose of the study is to establish the moment of conclusion of a foreign economic transaction by determining the competent legal order and establishing the content of the norms of Russian and foreign law applicable to disputed relations. During the research, such methods as analysis, synthesis, comparison, and generalization were used. The result of the conducted research is the establishment of the applicable law to relations concerning the conclusion of a foreign economic contract, the grounds and conditions for recognizing the contract as concluded, and the consequences of not recognizing the fact of concluding an international commercial contract.
