Abstract

The European Union (EU) has adopted the fourth generation of directives on public procurement, which promotes the vision on strategic public procurement, related to the agenda Europe 2020. This new normativity has proved to be particularly favourable for the overwhelming majority of enterprises in the EU, which belong to the category of small and medium-sized enterprises (SMEs). Among various measures established for the encouragement of SMEs, the mainstreaming one has to do with the principle of division of public contracts into lots. In the current framework of strategic public procurement, freedom of competition has been limited in a considerable way, mainly in the case of reserved contracts for certain services.
