Abstract

Article 51 TFEU excludes the application of Chapter 2 on the right of establishment, so far as any given MS is concerned, to activities that in that State are connected, even occasionally, with the exercise of official authority. It provides further that the EP and the Council, acting by the ordinary legislative procedure, may rule that the provisions of the chapter shall not apply to certain activities.
