Abstract
The analysis of the concept “human dignity” consists of two parts. Part I concerns the philosophical analysis, i.e., the definition of the term. Part II concerns the empirical analysis, i.e., the question whether the concept “human dignity” refers to reality. If there is a reference to reality, the concept is empirically saturated and therefore sufficiently qualified as the foundation of human rights. Otherwise, the concept is empty and under no circumstances qualified as a foundation of human rights.
