Abstract
The contribution deals with the legal aspects of the brain-computer interfaces (BCI) and, in particular, of those used for the assisted and augmented communication of subjects not able to express themselves with eye-controlled devices.
The chapter outlines the constitutional rights involved in the use of BCI, the European discipline applicable to their manufacture and, taking into consideration an Italian case-law, which seems to be extensible to other legal families, wonders the possible legal regime of the personal will expressed through those BCI so to protect vulnerable persons from abuse.
This chapter follows up some reflections previously discussed (in Italian) in F.G. It is worthy of consideration that—today, many years after the Nuvoli’s case—the quite recent Italian Act n. 219/2017 (Pizzetti 2019), pursuing the Articles 2 and 13 of the Italian Constitution and the Articles 1 and 3 of the EU Charter of Fundamental Rights, allows a disabled person to express the informed consent (Article 1), the advance directives (Article 4) or the care plan (Article 5), even with any device by which the same person may communicate. The Act, in fact, makes statutory lawful the usage, in clinical settings, of any type of assisted communicative device. In particular, the “openness” of the clause (any device by which the person can communicate without a specific reference to one or other type of communicative device) also covers the use of BCI (as instruments of communication). At the same time, the “vagueness” of the clause (which does not specify anything about the characteristic a device must have in order to be lawfully used) requires to fix a more detailed legal framework, like the one depicted in the Nuvoli’s case and here discussed.

At the same time, the tumultuous development of computer engineering is leading to the evolution of sophisticated machines, that are using “artificial intelligence” (AI) and become capable to mimick some traditional human abilities like learning by doing or by experience, flexibly and inductively (or “deep-learning”). Under that point of view, it is worthy of being mentioned the imminent manufacturing of BCI equipped with AI. Because the brain waves slightly differs in each individual, a BCI equipped with deep-learning feature will be more able more to learn, when the disabled person uses it, the specific waves’ pattern of its user and, therefore, to “adjust” and “refine” its power to interpret those brain’s signals and to translate them into “words”. Therefore, the BCI powered with AI will be better capable of interpreting the brainwaves’ flux and, therefore, to provide a more robust communication between the user and the others. Presumably, the “merging” between AI and BCI will make necessary to enrich the legal framework for BCI by taking into account also the ethical and legal principles on AI (not discussed here) (see, e.g.: Vessia and Muciaccia (2018), Barfield and Pagallo (2018)), like the ones recently put down by the EU Commission in its Communication: Building Trust in Human-Centric Artificial Intelligence (COM (2019) 168).
