Abstract

This chapter reconsiders Marx’s reflections on the rule of law and constitutionalism against a background of labour exploitation and authoritarianism. Marx emerges as a thinker whose support for constitutionalism following the failed revolutions of 1848 was based on the view that constitutional consolidation depends critically upon the extension of democracy to the economic sphere. A contemporary Marxist approach to law has good reasons for recognizing that legal victories matter for oppressed classes, without forgetting that robust social change depends on the contestation of economic power by means of political mobilization and resistance, especially in the current era of neoliberal authoritarianism.
