Abstract
In the principal cases described so far, the disputing parties undertook negotiation on their own. Increasingly, however, major environmental disputes are being negotiated with the assistance of a mediator, a practice borrowed from labor—management disputes and international conflicts. This chapter considers what the mediator brings to the bargaining table that the parties cannot provide on their own.
