Toward Deliberative Sentencing and Numerical Guidelines

This chapter first considers the implications for the development of detailed sentencing statistics of the results of the judges’ assessments relating to the model of judicial decision making. Then a proposal is made to use fictitious cases as a basis for statistics describing current sentencing policy and practice and as a means to develop and reform sentencing policy. Finally, an overview is presented of the course this study has taken in its attempt to open the judges’ exercise of the sentencing discretion to further quantification.
