Abstract
Fachkräftemangel, the shortage of skilled labour, is a much debated issue in Germany. Nevertheless, resistance to any large-scale liberalization of immigration remains strong. The chapter discusses why this is the case but also suggests that the introduction of a selective immgration scheme is likely.

In April 2008 the organisation of engineers, VDI, presented a study according to which a gap of 70,000 engineers existed, see FAZ 22 April 2008.

Shortages are particularly severe in process or methods engineering (Verfahrenstechnik), electrical, and mechanical engineering. As distinct from other countries, the health professions do not yet play a part in this debate. Relatively few medical doctors in Germany are foreigners, and recent increases have been moderate. According to the Bundesärztekammer (2006) 16,080 foreigners were practising as doctors. The overall figure for active medical doctors is 311,300.

The relevant directive (Anwerbestoppausnahmeverordnung, ASAV) lists exceptions on 30 grounds.

This is far more than the income of many German university professors.

In 2006, 21,000 Bildungsausländer, i.e. foreign citizens excluding those with a German school education, received a degree from a German university. This included 14,860 from third countries (BAMF 2007, pp. 64–65).

He also argues that international companies have access to foreign staff via intracompany transfers, which he describes as hidden migration channels. It remains however doubtful whether the requirements of the big companies can be satisfied via these channels—at least they keep complaining (see e.g. Wuttke 2007; Bräuninger 2007).

In 2005, the Central Register for Foreigners recorded 289,000 newly arrived foreign citizens with a stay of at least one year (Migrationsbericht 2006, p. 31). The migration figures (Wanderungsstatistik) of the national statistical office include a far greater number of in-migrations. Seasonal labour migrants are probably not fully captured by official statistics.

Minor adjustments came into force from November 2007 when access for electrical and mechanical engineers from East European EU-States was eased and the labour market preference rules were lifted for foreign graduates from German universities. Further changes came into force after January 2009.

It could be argued that this is not only true for high-skilled migration; schemes for the seasonal migration of labour from Eastern Europe have operated without much resistance in the past few years.

At least theoretically, foreigners on a toleration status can receive a more secure status if they hold a university degree and managed to find adequate employment in Germany for two years.
