Abstract

Commentaries on the juvenile law or analyses of juvenile justice practices generally make a clear distinction between two types of cases: those involving abuse or neglect of the child, usually by the parents; and those involving criminal behavior on the part of the child. In abuse and neglect cases the predominant interest is the immediate and future welfare of the child. It is the parents’ behavior that is on trial. In delinquency cases that are serious enough to make it to court the welfare interests of the child are balanced against the community’s interests in avoiding future crimes. The child’s behavior is on trial and provides the basis for imposing coercive controls.
