Abstract

My recommendations as to the insanity defense are not yet complete. In Chapters 10 and 11 the focus was on the law—on defining legally the essence of insanity in a psychologically intelligible way, which includes culpability for bringing about the disability of mind, and on writing test instructions and procedures for adjudicating the matter fairly and coherently. What has been left out, and what still remains, is the matter of the psychological expert. What role is the psychological expert to play during the insanity drama and after?
