Disability/Legal Issues for Asthmatics

Abstract

The treatment of asthma frequently requires some modification in the interaction between a patient and their environment. Individuals who suffer a significant disability as a result of an asthmatic condition may be entitled to several forms of remedial compensation including adjustment of their occupational environment. The physician should be familiar with the legal remedies that may be available to reach these ends. For the patient to avail of these remedies, a physician will have to provide an opinion on the nature, extent, and etiology of the patient’ s respiratory problems. This may require only a written opinion but can frequently involve testimony as an expert witness. This chapter will review the legal rights and remedies available to the patient and some current issues concerning the testimony of expert witnesses.
