Abstract

As described in Chapter 2, the H-1B process involves working with four different US government agencies: DOL, USCIS, DOS, and CBP. Generally, the employer is primarily responsible for interaction with the first two agencies, and the employee for interaction with the last two. This chapter will discuss the employer’s inputs into the process necessary to successfully navigate the H-1B case through the DOL and USCIS, from the first steps to petition approval. Although these processes initially may seem daunting, the employer normally will be assisted by an immigration attorney. Often the time commitment by HR to H-1B cases can be limited to an hour or two per case.
