Abstract
To teach “how to make” a biotechnology invention (35 USC § 112, ¶ 1; see § 420), it may be necesssary to include reference to a biological deposit in the specification as filed. In some cases, the “best mode contemplated” requirement (35 USC § 112, ¶ 1, see § 450) may mean that a deposit will have to be included as well.
