Abstract

“Prosecution history estoppel” is the Federal Circuit’s label for the doctrine that the Supreme Court has called “file wrapper estoppel”. This doctrine is applied only to block the doctrine of equivalents; in other words, if there is literal infringement (not requiring use of the doctrine of equivalents), then there is no inquiry necessary under prosecution history estoppel.
