Abstract

The structure and roles of the family, in general, have evolved only slowly over a long period of time and are still in a process of change. The most decisive change in modern times came about with industrialisation and led to much smaller families, the development of the nuclear family (mother, father and children) and to many of the functions of the family moving outside its sphere and control. Thus industrialisation led to the clear division of employment and family life, the development of the formal education of children through schools and increasingly, although slowly, to the provision of health care and social security through the State.

  38. The author attended a divorce case at the city court, Berlin in 1981. The proceedings were much less formal than in Britain. The woman judge laid particular emphasis on the lack of partnership and equality which had been achieved within the marriage and on the interests of the child. The questions put by the lay assessors showed that they had a good knowledge of the law but they were also very practical and commonsensical in their approach. The assessors were both local factory workers and were men.
