Enforcing the Criminal Law

Abstract

At the one extreme, the discretion of consumer agencies comprises the unmonitored and largely irrevocable decisions of individual enforcement officers to overlook offences of which they become aware. At the other extreme is the institution of legal proceedings, with the possibility that this may involve a matter progressing through a hierarchy of courts. Consumer agencies exercise a wide ameliorative discretion within these outer boundaries. Routine decisions are made not to proceed where unlawful behaviour has obviously occurred. If a consumer complains about a matter which involves a criminal offence, there is no guarantee that a prosecution of the offending business will be brought.
