The Cuban Nationalisations in the United States Courts: The Sabbatino Case and its Progeny
On 6 August 1960 stevedores at the port of Santa Maria on the southern coast of Cuba commenced loading 14,000 tons of sugar on board the S.S. Hornfels, a steamer bound for Morocco. The sugar had been produced by Compania Azucarera Camaguey de Cuba (referred to in the litigation which followed as CAV), one of Cuba’s largest sugar companies. Like most of Cuba’s sugar producers, it was owned by nationals of the United States. The sugar was to be shipped pursuant to a contract of sale between CAV and Farr Whitlock & Co., a United States sugar dealer.
