The Legal Nature of the Employment Relationship
It is an unfortunate fact that we must start this book with its most tedious chapter. The layman may well think that the law here diverges widely from the realities of workplace practices; he would be right, but whatever the realities of collective bargaining relationships may be, English law demands that we begin with the individual contract of employment. Any study of English labour law has to start here. Therefore we must analyse this relationship between the employer (conventionally, if archaically, known as ‘the master’) and the employee (conventionally, if insultingly, called ‘the servant’).
