The Final Cut: Authority and Democracy in Contemporary Iran: From National Borders to the Idea of Islamic Empire

Abstract

This chapter examines two different schools of Jurisprudential Islam, given there have been various interpretations derived from the ideas of Khomeini in respect to the constitutional law of Iran which became more prominent after his death. Since 1989, these two schools have been the main players in Iran’s political scene. One is based on the ideas of Ayatollah Seyyed Mohammad Hosseini Beheshti, Ayatollah Hussein Ali Montazeri, Ayatollah Nematollah Salehi Najafabadi and Hojatoleslam wal-muslemin Davood Feirahi, who consider people to be the source of political legitimacy, whereas the other school is based on the ideas of Ayatollah Javadi Amoli, Ayatollah Mohammad Momen and Ayatollah Mohammad Taqi Mesbah Yazdi, who believe political legitimacy derives from a divine source. Both schools have presented themselves in the framework of Jurisprudential Islam.
