Mind the Gap: The Creation of the Non-Divertible

Abstract
Discussion in West Germany about diversion has concentrated on net-widening effects. But the creation of the “non-divertible” is another danger. Efforts to remove young offenders from the justice system has lead to feasible plans, projects and alternatives for those seen to be divertible. But imprisonment still remains as the measure for the non-divertible. What contributes to this categorization? How can the groups be distinguished? What happens to those who miss opportunities for diversion? What dangers emerge from such a binary categorization?
