Zusammenfassung

In diesem Beitrag sollen zunächst unterschiedliche Ansätze zu psychologischen Theoriebildungen über das „Rechtsgefühl“ durch Rechtswissenschaftler skizziert werden. Sodann werden vier zeitgenössische sozialpsychologische Ansätze zur interpersonalen Gerechtigkeit dargestellt und auf den möglichen Stellenwert eines „Rechtsgefühls“ untersucht, wobei jeweils mögliche spezifische Hypothesen und ggf. vorliegende empirische Befunde zu richterlichen Entscheidungen skizziert werden. Abschließend wird ein kurzer Vergleich der Theoriebildungsversuche zum Thema „Rechtsgefühl“ von rechtswissenschaftlicher und sozialpsychologischer Seite gezogen.
