This chapter posits the need for maintaining exclusivity over digitised versions of rare documents as a means of channelling private sector (for-profit) investment into the digitisation process. It explores the question whether a failure to secure adequate levels of private sector investment could lead to market failure in the end-user and re-user markets for digitised versions of rare documents. Finally, it analyses the nature and scope of exclusivity that is required for creating investor incentives while at the same time, ensuring that user interests are preserved to a satisfactory level.
