Kapitel 5: Grundsatzfragen zur Vollstreckungsimmunität
Zusammenfassung
Analysiert man den aktuellen Völkerrechtsstand zur Vollstreckungsimmunität, so muss der Blick zunächst den basalen Strukturen gelten, auf denen sowohl die anerkannten Ausnahmen als auch die neueren Einschränkungsansätze beruhen. Am Anfang steht dabei die Frage, ob die Vollstreckungsimmunität als Grundsatz des Völkerrechts zu betrachten ist, von dem bestimmte Ausnahmen zu machen sind, oder ob nicht die Territorialhoheit des Forumstaates und damit der hoheitliche Vollstreckungszugriff auf alle im Staatsgebiet befindlichen Sachwerte die völkerrechtliche Basis ist, von der die Vollstreckungsimmunität eine – zunehmend begrenzte – Ausnahme darstellt.1 Zudem wird untersucht, ob durch das Völkergewohnheitsrecht neben der ergebnisorientierten Pflicht zur Freistellung fremder Staaten von der nationalen Gerichtsbarkeit verfahrensrechtliche Vorkehrungen für das Vollstreckungsverfahren gefordert werden, in die die Vollstreckungsimmunität eingebettet ist.2
