Abstract

The legal relationship between an employer and employee is not solely governed by employment and tax law. A third pillar is social law, or more specifically, social insurance law. The constitution of the Federal Republic of Germany expressly professes itself a welfare state. The principle of the welfare state as anchored in the constitution comprises the requirements for social insurance and social justice.
