Private Property Balanced with the General Interest on International Ground

Abstract

This chapter shows the increasing problem of violation and/or deprivation of property rights via the arbitrary interference of the state governments on the international ground. It will demonstrate the wide definition of property in international law, the general principles and tests applied by the ‘European Convention on Human Rights,’ or the ‘ECHR’ and mainly, via international case law of different bodies demonstrating how and when private property rights are intervened with and the tests applied. This chapter will also show the positive obligations that can be held by international courts for the protection of property rights and other individual rights.
