Abstract

Usages can be compared to contracts; these two norms have similarities; however, usages have their own characteristics. This is the case concerning the delimitation of the scope of the usage.

The delimitation of the scope of the usage corresponds to the domain where usage can be observed and produce a legal effect. The latter can be distinguished from the content of the usage that is the underlying practice whose generalization may create a usage.

The delimitation of the scope of the usage is singular; however, it is not unique. Therefore, it deserves attention for more than one reason. Firstly, it is essential in order to recognize the existence of usages; secondly to determine the legal force attached to them, and finally to rule on their invocability.

Consequently, this presentation will firstly analyze the characteristics of this delimitation, and secondly its functions.
