Abstract

The current legal protection of trade secrets and confidential information in Brazil derives from the TRIPS Agreement, signed in 1994 and enforced in the country since January 1, 1995. This chapter aims at providing an overview on how trade secrets are regulated in Brazil, encompassing some definitions, the crimes against trade secrets, the civil liabilities related thereto and calculation of damages. In addition, some specificities of Brazilian legislation, such as the handling of confidential information by the Trial and Appeal Courts, are further detailed.
