A Contract Theory of Secession

  • Pau Bossacoma Busquets
Part of the Federalism and Internal Conflicts book series (FEINCO)

This chapter develops a moral theory of secession based on a hypothetical multinational contract. This contract theory ascribes a primary right to secede to minority nations. Despite no previous injustice being necessary to secede, this primary right is neither absolute nor unqualified, but subject to several procedural, substantive and material requisites. In most cases, especially in liberal-democratic contexts, making secession difficult seems more reasonable than making it impossible.
