International Element, Quest to Statehood and International Law
Abstract
With the aim of demonstrating the dimension of the involvement of the ‘international element’ in the process of Kosovo’s emergence as a state (state formation), it is necessary to focus on two particular points. The first point questions the extent to which the ICJ influenced the state formation process and Kosovo’s status under international law in the purview of existing legal contestations and means to clear them. As the involvement of the ICJ cannot be assessed isolated from its Advisory Opinion on the accordance of Kosovo’s unilateral declaration of independence with international law, the latter is beheld as the tool through which the ICJ mainstreamed its influence in both, Kosovo’s state formation and its international legitimacy.
