Abstract

The status of a teacher is not directly regulated under EU law, as the Union does not have specific competences in the field of education—it only coordinates and supports the actions of the Member States. However, states are permitted under the freedom of movement principle to restrict access to this profession to their own citizens. In addition, with the European Quality of Learning Objective, the Union is promoting higher standards for teachers’ recruitment and training, including updating because of the new digital technologies and enhancing their professional profiles. Lastly, the European Court of Justice has ruled against abuse in the renewal of teachers’ fixed-term contracts, because this breaches the European Framework Agreement.
