Abstract

The EU legal system offers a restrictive concept of ‘employment in the public service’, which coincides with the exercise of ‘functions of authority’ (Art. 45(4) TFEU). Outside this restricted perimeter, the free movement of workers has full effect and establishes the obligation to overcome any distinctions of nationality for access to the civil service and to ensure equality of treatment for European and national citizens. More broadly, all of the Union’s ‘social rights’, together with the rights established by the ECHR, have affected national definitions of public employment. Nevertheless, European law seems to accept the fundamental elements of the status of a public officer as defined by the national legal traditions.
