Abstract

This chapter examines the doctrines of al-Diyāh and al-Damān in the light of the contemporary reality. It aims to outline how to apply the doctrine of al-Diyāh as a solution to the quantum of damages in the Takaful industry, and as an apt alternative to principles applied under conventional insurance practices.
